Terms of service
Last updated:
These terms describe how Accura works today. They are being reviewed by our lawyer; if anything here is unclear, write to jkuldevllc@gmail.com.
1. About these terms
These terms are an agreement between jKulDev LLC (“we”, “us”) and the shop or business that uses Accura (“the shop”, “you”). The person who creates a shop or accepts these terms for it confirms they are allowed to bind the shop. Every person who signs in also agrees to follow them.
Accura is offered to businesses for their work, not to consumers. If a law that protects consumers still applies to you, nothing here takes those rights away.
Our Privacy policy and our Data processing addendum form part of these terms. A written agreement signed with us (for example for Enterprise) wins where it differs.
2. Accounts and signing in
Each person needs their own account; do not share sign-ins. You sign in with your email address or Nepal mobile number and a password. Keep your password safe and tell us at once at jkuldevllc@gmail.com if you think someone else has used your account. You are responsible for what is done with your account.
You must be at least 18 (or have a guardian's consent where the law allows) and give true details.
3. The shop's owners and staff
The owner decides who joins the shop, with which roles, for which branches — by sending an invite code or by making a login with a temporary password that the person must change at first sign-in. Owners are responsible for giving and removing access promptly, for the shop's settings (for example PAN and VAT, locked periods, negative stock, counter PCs, the website), and for telling the shop's people how their data is used (see the Privacy policy, “For shops”).
A shop always keeps at least one owner. An owner can reset a staff member's password only for staff who work for that shop alone.
4. Plans and limits
The plans — Free, Counter, Shop, Multi-branch, Wholesale and Enterprise — what each includes and its limits (people, branches, bills a month, items, offline counter PCs, AI requests, storage and website views) are shown on the pricing page and in the app under Business → Plan. Every plan has the full set of billing, stock and accounts features; plans differ in size and AI use.
- Free — includes a one-time trial of Sahayak questions; it does not refill.
- Limits — when a limit is reached, the action that would pass it (adding a person or branch, another bill this month, another AI question) is refused and the app says why. Reading your books is never blocked by a plan, and nothing is deleted when you move to a smaller plan.
- AI requests — each paid plan includes requests every month, which do not carry over. Requests you buy never expire and are used after the monthly ones.
5. Prices, VAT and paying
- Prices are in Nepali rupees and exclude VAT, which is added at 13 %. A plan is paid for a month or a year at a time; a year costs less than twelve months.
- Gossip-linked price — a shop whose owner links a verified Gossip account pays the lower Gossip price (25 % off) while the link is active. One Gossip account can be linked to one shop at a time. If the link ends, the standard price applies from the next payment.
- Paying — online through Khalti or eSewa from Business → Plan, or as we agree in writing. A payment counts only once the gateway confirms it to our server. You pay any gateway or bank charges.
6. Renewal, late payment, plan changes and refunds
- No automatic charges — paid plans do not renew by themselves. Paying again for the same plan extends it from its current end date.
- Late payment — if a paid plan is not renewed, it keeps working for 7 days after its date, then works as Free until it is renewed. Your books stay.
- Changing plan — paying for a different plan starts it that day for a full month or year; unused time on the old plan is not credited. An owner can move to Free at any time.
- Price changes — we may change prices or plan contents. A higher price applies from your next payment, and we will tell owners at least 30 days before.
- Refunds — payments for plans and AI requests are not refunded, except where the law requires a refund or we made a billing mistake.
7. Your data
The shop owns the records it and its people put into Accura (“your data”). You give us permission to host, copy, process and show your data only to provide, secure and support Accura for you, and as our Privacy policy and Data processing addendum describe.
You can download your books at any time: masters and vouchers for Tally (XML), and the sales and purchase books and IRD bill view (CSV). You are responsible for having the right to what you upload, and for keeping your own copies of records you are legally required to keep.
We may use counts and usage figures that do not identify a shop or a person (for example how many bills are made a month) to run and improve Accura, and to see what each plan costs us. If you send us suggestions, we may use them without owing you anything.
8. Personal data
For personal data in your records — your customers, suppliers and staff — we act as your processor. Our Data processing addendum sets out those terms and applies automatically as part of these terms. You are responsible for having a lawful basis for the personal data you put into Accura, and for telling your people about it.
9. Acceptable use
Do not use Accura to: break the law or anyone's rights; make false bills or hide sales from the tax authorities; upload malware or anything you do not have the right to share; publish on your shop website anything unlawful, misleading or that you do not own; try to reach shops, data or features you have not been given; probe, overload or bypass our security or plan limits; or scrape or resell the service without our written agreement. We may remove content or suspend access that breaks this, and will tell you why unless the law or safety prevents it.
10. Sahayak, the AI assistant
Sahayak's answers are worked out from your books but may be incomplete or wrong. Check figures that matter in the reports themselves. A bill Sahayak drafts from your voice is only a draft — a person must check it and save it at the counter. Sahayak never saves or changes anything, and AI use counts against your plan's credits.
11. Bills, VAT and IRD (Nepal)
Accura is built to follow Nepal's computerised billing rules: gap-free bill numbers, bills that cannot be edited once saved (a cancel keeps the number and the reason; returns are made with credit notes), the first print marked as the original and every later one as a copy, a print log that cannot be changed, and the sales and purchase books and IRD bill view. Abbreviated tax invoices stay off until the owner confirms the tax office has approved them for the shop.
Accura is not approved or enlisted by IRD as billing software, and it does not report bills to IRD's Central Billing Monitoring System. The shop is responsible for its bills meeting the VAT and income-tax rules, for any approval of its billing software the law requires, for its tax returns and payments, and for keeping its records for as long as the law requires.Bills are never deleted, and we never delete a shop's bills while its books are kept.
12. Working offline and the desktop app
A registered counter PC can keep billing when the internet is down, in its own series of bill numbers. Those bills exist only on that PC until it is back online and sends them. If the browser's storage is cleared, or the PC is lost or broken before then, they can be lost — let the PC reconnect as soon as you can. Bills made offline may be flagged for a look (for example when stock had already run out); someone in the shop must check them.
The desktop app shows your shop's staff app in its own window and prints to your local printers. Keep it and your computer's operating system updated.
13. Your shop's address and website
A shop may get its own address. We may refuse or change an address that is misleading, offensive or uses someone else's name or brand.
The website is off until you switch it on. You are responsible for everything you publish on it — text, prices, photos, contact details — and for having the right to publish it. Website views and photo storage are counted against your plan; uploads over the storage limit are refused.
14. Other services
Some features use services of others under their own terms: Gossip (Sahayak's AI, the Gossip account link and the “Chat on Gossip” button), Khalti and eSewa (payments), Google (fonts and maps), WhatsApp, and Tally (which you use with the files you download). We are not responsible for those services.
15. Support and our access
We give support by email at jkuldevllc@gmail.com on working days. To fix a problem or check your books' health we may look at your shop's records, only for that purpose. We never post, cancel or change your bills or vouchers without your request.
16. Availability and changes to the service
We work to keep Accura available and your data safe, and to back it up, but we do not promise it will always be available, error-free or uninterrupted — maintenance, outages of our providers and events outside our control can happen. We may change, add or remove features; we will not remove a major feature you are paying for during a paid period without telling you first. Features described as coming later are not promised.
17. Suspension and ending the agreement
You can stop using Accura at any time: move to Free, or ask us to close the shop. Payments already made are not refunded (see above).
We may suspend or end access, after notice where reasonable, for non-payment, serious or repeated breach of these terms, risk to the service or others, or when the law requires it. A suspended shop's records are kept. When an agreement ends, the shop can download its books; we will delete the shop's records on the owner's written request, except what the law requires us to keep.
18. No warranties
Except as these terms say, Accura is provided “as is” and “as available”, and we give no other promises or warranties, express or implied (for example of fitness for a particular purpose), to the extent the law allows. Accura is not tax, accounting or legal advice.
19. Limits on our liability
To the extent the law allows: (a) neither side is liable for indirect or consequential loss, or for lost profits, revenue or data that could have been prevented by keeping copies; and (b) our total liability for all claims in any 12 months is limited to the fees the shop paid us for Accura in the 12 months before the event that caused the claim (or NPR 10,000 if it paid nothing). Nothing limits liability that cannot legally be limited, such as for fraud.
20. Governing law and disputes
These terms are governed by the laws of Nepal. We will first try to settle any dispute by talking. If that fails within 30 days, the courts of Kathmandu, Nepal have jurisdiction.
21. Changes to these terms
We may update these terms. If a change matters, we will tell shop owners at least 30 days before it takes effect (sooner only where the law or security requires). Continuing to use Accura after that means the shop accepts the change; if it does not, it can stop before then.
22. General
Neither side is responsible for delays caused by events outside its reasonable control. You may not transfer these terms without our consent; we may transfer them with our business. If a part of these terms is invalid, the rest still applies. Not enforcing a right is not giving it up. These terms (with the documents they refer to) are the whole agreement about Accura. We send notices by email to the shop's owners or in the app; you send them to jkuldevllc@gmail.com. If the English version and a translation differ, the English version applies.
